RELEASE AND WAIVER OF LIABILITY FOR THE BE WITH KIDS PROGRAMS
By joining any free or paid Be WITH Kids programs you agree to accept all parts of this Release and Waiver.
Assumption of Risk. There are sometimes unknown individual risks and circumstances that can arise during programs that cannot be foreseen. You understand that your participation in programs, at any level, is to be taken at your own risk, with no liability on Be WITH Kids part, recognizing that there is a rare chance that illness, injury or even death could result. Additionally, you acknowledge that you are using your own due diligence and assessment of risk when it comes to making your own decisions for yourself and your children or the children in your care, and you are voluntarily making those decisions with the full awareness that there may be risk involved to you, your children, or the children in your care. By participating in any program by Be WITH Kids, you expressly assume any risks, injuries or damages, known or unknown, which your children, the children under your care, or you might incur as a result of participating in the programs.
Personal Responsibility. By participating in Be WITH Kids programs you are acknowledging that you are solely and personally responsible for your own preparedness, health, life, well-being, choices, actions and results at all times, and for those of your children or children under your care. You are responsible for researching the program in which you are voluntarily participating, knowing the material provided, and using the proper gear for yourself and children. You understand that you are responsible for your safety when you choose to challenge your capabilities or personal health conditions during the program, for determining whether a program is at an appropriate level for you and your family and the children, and for participating based on solely your own judgment. You take full responsibility for having appropriate skills and physical conditioning, equipment and supplies for all programs.
The Role of Program Facilitators, Instructors and Organizers. You understand and agree that the sole role of the Program Facilitators and Organizers is to organize the logistics of the program. They are not responsible for your safety or well-being or of that of your children or children under your professional care.
No Liability. You agree to waive liability of the Program Facilitators, Instructors and Organizers or any other member of a Be WITH Kids team, for any accidents, delays, injuries, mishaps, harm, loss, damage, death, lost profits, personal or business interruptions, misapplication of information, physical or mental disease, condition or issue, or otherwise, affiliated with Be WITH Kids or otherwise, even if you are expressly advised of the possibility of such damages or difficulties, whether caused by the fault of yourself, the Organizers, other participants or other third parties. This release and waiver extends and applies to, and also covers and includes, all unknown, unforeseen, unanticipated and unsuspected injuries, damages, loss and liability. In no event will you hold the Program Facilitators, Instructors or Organizers or any other member of Be WITH Kids liable for any direct, indirect, special, incidental or consequential damages for any use or non-use of, or reliance on, the programs.
No Insurance. Be WITH Kids does not provide liability insurance for the protection of individuals who may participate in any of the events or programs that take place with the Be WITH Kids. You hereby waive and release all rights and claims for damages against Be WITH Kids and its officers, members and families personally for all injuries which may be sustained by you or any family member(s) while participating in the programs you attend. You understand the content of the program and the risks of personal injury herein. You further agree to indemnify and hold harmless Be WITH Kids and each of its members from any claim for loss or damage or injury or death to yourself, any member of your family, or a child under your professional care arising from or in connection with any participation in the programs.
Release of Claims. In consideration of being permitted to participate in programs, you knowingly, voluntarily and expressly waive any claim you may have against Be WITH Kids, its Program Facilitators, Instructors and Organizers for any injury or damages that you may sustain as a result of participating in the programs. You agree now that you hereafter forever release Be WITH Kids, its Program Facilitators, Instructors and Organizers from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which you have ever had, now have or will have in the future against Be WITH Kids, arising from your past or future participation in, or otherwise with respect to, any acts or omissions or anything related to the programs.
Media Waiver. You authorize us to use the following information that you have submitted in any way to Be WITH Kids relating to you, your children and your family: your picture – including photographic, motion picture, and electronic (video) images. You hereby grant to us the right to use, publish, and reproduce, for all purposes pictures of you in film or electronic (video) form, sound and video recordings of your voice, and printed and electronic copy of the information described in sections (1) and (2) above in any and all media including, without limitation, cable and broadcast television and the Internet, and for exhibition, distribution, promotion, advertising, sale, press conferences, meetings, hearings, educational conferences and in brochures and other print media. You further grant us all right, title, ownership and interest that you may have in all finished pictures, negatives, reproductions, and copies of the original print, and further grant us the right to give, sell, transfer, and exhibit the print in copies or facsimiles thereof, for marketing, communications, advertising or for any other purpose, as it deems fit. You also understand that Be WITH Kids is not responsible or liable in any way for photos or other information that other participants post on social media or otherwise share or distribute as we have no control over others’ actions. Should you object to a photo of you or other information being posted or shared by another participant, you understand that you need to contact that member directly and ask him/her to remove or take down the image or information as Be WITH Kids is not involved or responsible for that situation.
Voluntary Consent. You acknowledge that you are participating voluntarily in these programswith the full awareness that your participation may contain certain inherent risks to you, your children or the children under your professional care, and you voluntarily consent to all such risks. You give full consent to participating in the programs, and by providing your consent, you voluntarily agree to all of the terms of this Release and Waiver. Regardless of whether you have provided your signature or not, your participation in a program signifies that you have read this Release and Waiver and you fully understand and implicitly consent to all of its contents.
